Welcome. These are the terms that govern your use of fauxandfabulous.com and any purchase you make from us. Please take a moment.
By browsing or buying from this site, you agree to these terms. If you don't, please don't use the site.
We've kept this as plain-English as we reasonably can. If anything's unclear, email us — we'll happily walk you through it.
Who we are
Faux and Fabulous is an Australian online retailer of ready-to-place faux floral arrangements, operated from Melbourne, Victoria. Throughout these terms, "we", "us" and "our" mean Faux and Fabulous.
Who you are
To buy from us, you need to be at least 18 years old and a resident of Australia. (We ship Australia-wide only at this stage.) If you're buying as a business, you confirm you have authority to do so on the business's behalf.
Our products
Every arrangement is photographed in its actual vessel under daylight. Colours can shift slightly on different screens — we've done our best to make what you see online faithful to what you'll receive. If something arrives and the colour reads differently in your home, we'll work with you to make it right under our Refund Policy.
Our pieces are described as handcrafted in Melbourne — meaning each arrangement is hand-styled and quality-checked here. Individual flower stems and vessels are sourced from a global supply chain. We disclose this honestly because we'd rather you knew.
We reserve the right to limit quantities, refuse orders, or discontinue any item without prior notice.
Pricing
All prices are in Australian dollars and include GST. We may change prices without notice; the price that applies to your order is the price displayed at the time you check out.
We try hard to keep pricing accurate, but if a clear pricing error occurs (a product listed at significantly below cost, for example) we may cancel the order and refund you in full. We'll always tell you before we do this.
Orders
When you place an order, you're making an offer to buy. We accept your offer when we send you a dispatch confirmation. Until then, we may decline the order at our discretion (very rarely, and we'll always explain why).
You can cancel an order any time before it ships by emailing us. Once it's shipped, our Refund Policy takes over.
Shipping
Free standard shipping on orders over $200 within Australia. Full shipping detail (timeframes, signature on delivery, what happens if you're not home) lives in our Shipping Policy.
Returns and refunds
We offer 14-day returns on unused arrangements in original packaging. Damage in transit is covered. Full detail in our Refund Policy.
These terms don't reduce your rights under the Australian Consumer Law. You're entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You're also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure isn't major. Nothing in these terms attempts to exclude, restrict or modify those rights.
Your account
If you create an account, you're responsible for keeping your password confidential and for any activity that happens under your login. Let us know straight away if you suspect unauthorised use.
We use Shopify's customer accounts system — when you sign in, you're using Shopify's authentication, not a password we hold ourselves.
Reviews and submitted content
If you leave a review, send us a photo of our pieces in your home, or otherwise submit content to us, you grant us a non-exclusive, royalty-free, worldwide licence to use, edit and display that content in connection with our business (on the site, in marketing, on social channels). You confirm the content is yours to share and isn't unlawful, defamatory, or infringing.
We may decline or remove any submitted content at our discretion.
Intellectual property
The site — including our copy, design, photography, brand and the "Faux and Fabulous" name — is our intellectual property, or used under licence. You may browse, print and download content for personal, non-commercial use. You may not reproduce, republish, or commercially exploit any of it without our written permission.
Acceptable use
Don't use the site to do anything unlawful, harmful, deceptive, or that interferes with the operation of the site or other users' experience. Specifically: no scraping, no automated ordering, no security probing, no impersonation, no spam, no infringement of others' rights.
Privacy
We collect and handle personal information in line with our Privacy Policy. By using the site, you agree to those practices.
Disclaimers
To the maximum extent permitted by law — and subject always to the consumer guarantees set out in the Australian Consumer Law — the site and our products are provided on an "as is" basis. We don't warrant that the site will be uninterrupted, error-free, or that defects will be corrected immediately.
Photographs are descriptive, not exact. Dimensions are accurate to within a centimetre and we list them on every product page.
Limitation of liability
To the maximum extent permitted by law, our liability for any claim arising out of or in connection with these terms or your use of the site is limited to the price you paid for the relevant product. We're not liable for any indirect, consequential, special, or punitive loss.
Nothing in these terms excludes or limits any liability that cannot be excluded under Australian law, including under the Australian Consumer Law.
Indemnity
You agree to indemnify us against any loss or damage we suffer as a result of your breach of these terms or your misuse of the site.
Changes to these terms
We may update these terms from time to time. The "last updated" date at the top reflects the most recent change. Material changes will be flagged on the site. Continued use of the site after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of Queensland, Australia. Any dispute will be resolved in the courts of Queensland, unless we agree otherwise in writing.
